BARU Events & Party Supplies – Hire Terms & Conditions
These Hire Terms & Conditions apply to all decorations, equipment, lighting, centrepieces, props, displays, accessories and other items (“Hire Items”) hired from BARU Events & Party Supplies (“BARU”).
Please read these Terms & Conditions carefully before making a booking. By confirming a booking and paying the required booking deposit, the Customer acknowledges that they have read, understood and agreed to these Terms & Conditions.
1. Ownership of Hire Items
All Hire Items remain the property of BARU Events & Party Supplies at all times.
Hiring an item does not give the Customer any ownership rights.
The Customer must not sell, sub-hire, lend, dispose of or transfer possession of Hire Items to another person or organisation without BARU’s prior written permission.
2. Bookings
Customers should contact BARU to confirm the availability of the required Hire Items and event date.
A booking is confirmed only after BARU has confirmed availability, the required booking information has been provided, the Customer has accepted these Terms & Conditions and the required booking deposit has been received.
BARU will provide a booking confirmation or invoice showing the Hire Items, quantities, event date, hire charges and any agreed delivery, setup, collection or other services.
Hire Items will not be reserved until the required booking deposit has been received.
3. Customer Responsibilities
The Customer is responsible for taking reasonable care of the Hire Items from the time they are collected or delivered until they are returned to or collected by BARU.
Hire Items must only be used for their intended purpose and in accordance with any reasonable instructions provided by BARU.
The Customer must not modify, dismantle, paint or alter Hire Items without BARU’s permission.
Glue, adhesive tape, nails, screws, staples, pins, wire, stickers or other materials that may damage Hire Items must not be attached without BARU’s permission.
Flowers, feathers, lighting, electrical components and other decorative elements must not be removed, rearranged or substituted without permission.
The Customer must take reasonable steps to prevent guests, children or other persons from climbing, sitting, pulling, hanging from or otherwise misusing Hire Items that are not designed for that purpose.
If an item appears damaged, unstable or unsafe, the Customer must stop using it and notify BARU as soon as reasonably possible.
4. Hire Period and Late Returns
The hire period begins at the agreed collection or delivery time and ends when all Hire Items have been returned to, or collected by, BARU.
Unless otherwise agreed in writing, all Hire Items must be returned or made available for collection within two (2) days after the event, at the date and time agreed with BARU.
Hire Items returned after the agreed return period will incur a late return fee of $50 per day until the Hire Items are returned to, or successfully collected by, BARU.
Where a late return affects another confirmed booking or causes BARU to incur additional reasonable costs, the Customer may also be responsible for those costs.
Applicable late-return fees may be deducted from the security bond. If the security bond is insufficient, the Customer must pay the outstanding balance.
BARU will advise the Customer of any deduction made from the security bond.
5. Hire Charges, Booking Deposit and Payment
The total hire price, including the Hire Items and any applicable delivery, setup, collection, customisation or other agreed services, will be clearly stated in the Customer’s booking confirmation or invoice.
Booking Deposit
A booking deposit is required to secure the event date and reserve the selected Hire Items.
For bookings with a total value of $500 or less, a $50 booking deposit is required.
For bookings with a total value over $500, a booking deposit equal to 20% of the total booking value is required.
The booking deposit forms part of the total hire price and is not an additional charge.
A booking is not confirmed and Hire Items will not be reserved until the required booking deposit has been received.
Remaining Balance
The remaining balance must be paid in full no later than ten (10) days before the event, unless otherwise agreed in writing by BARU.
For bookings made within ten (10) days of the event, the full hire amount must be paid at the time of booking.
6. Security Bond
A refundable security bond is required for all Hire Item bookings.
The security bond is separate from the booking deposit and hire charges.
Standard security bonds are:
Total hire value up to $200 – $100 security bond
$201 to $500 $150 security bond
$501 to $1,000 $250 security bond
Over $1,000 security bond starting from $300 Max $500
For bookings over $1,000, or bookings containing particularly valuable, large, fragile or specialised Hire Items, BARU may require a higher security bond based on the quantity, type and reasonable replacement value of the Hire Items.
The exact security bond will be disclosed before the booking is confirmed.
The security bond must be paid in full before Hire Items are collected, delivered or installed.
After the Hire Items are returned or collected, BARU will inspect them.
Where no deductions are required, BARU will process the security bond refund within five (5) business days.
BARU may make reasonable deductions for damage beyond reasonable wear and tear, missing or lost items, excessive cleaning, unauthorised alterations, late-return fees or other amounts properly payable under these Terms & Conditions.
BARU will advise the Customer of the reason and amount of any deduction.
The security bond does not limit the Customer’s responsibility where reasonable repair or replacement costs exceed the bond.
7. LED, Electrical and Illuminated Products
Some BARU Hire Items contain LED lighting, rechargeable batteries, electrical components, cables, chargers or power supplies.
Customers must follow any operating and safety instructions provided by BARU.
Unless BARU specifically confirms that an item is suitable for outdoor or wet conditions, electrical and illuminated Hire Items must be protected from rain, water and excessive moisture.
Customers must not open, modify or attempt to repair electrical or illuminated Hire Items.
Any malfunction should be reported to BARU as soon as reasonably possible.
8. Large and Freestanding Decorations
Large Hire Items, including oversized displays, cake or bottle presenters, hoops, arches, large centrepieces and other freestanding decorations, must be placed on a stable and suitable surface.
Hire Items must not be climbed on, sat on, pulled, dismantled or used for a purpose for which they were not designed.
Where BARU has professionally installed a Hire Item, the Customer or venue must not move or substantially reposition it without BARU’s permission.
9. Outdoor Use and Weather
The Customer must tell BARU before booking if Hire Items will be used outdoors.
Unless specifically confirmed otherwise by BARU, Hire Items should be considered suitable for indoor or protected outdoor use only.
BARU may refuse to install or continue using Hire Items where rain, excessive wind, extreme heat, unsafe ground conditions or other environmental conditions create an unreasonable safety risk or risk of damage.
10. Customer Collection and Transport
Where the Customer collects Hire Items, the Customer is responsible for providing a vehicle and transport method suitable for safely carrying the equipment.
Hire Items must be appropriately secured and protected during transportation.
BARU may refuse to release a Hire Item where BARU reasonably believes the proposed transportation method is unsafe or likely to damage the Hire Item.
11. Condition and Inspection
BARU will endeavour to provide Hire Items clean and in good working condition.
The Customer should inspect the Hire Items upon collection or delivery and promptly notify BARU of any existing damage, missing components or concerns.
BARU may photograph Hire Items before and after hire to record their condition.
Customers will not be charged for reasonable wear and tear arising from normal and proper use.
12. Delivery, Setup and Collection
Delivery, setup and collection services are available subject to the event location, travel distance, accessibility and BARU’s approval and availability.
Delivery, setup and collection are not automatically included in the Hire Item price unless specifically stated in the Customer’s booking confirmation or invoice.
Location and Distance Approval
Before BARU agrees to provide delivery, setup or collection, the Customer must provide the complete venue name and address.
BARU will review the venue location, travel distance, Hire Items and access requirements before confirming whether delivery, setup and collection can be provided.
BARU is not required to provide delivery, setup or collection to a location that BARU considers outside its reasonable service area or travel distance.
For locations outside BARU’s standard service area, BARU may agree to provide the service for an additional travel charge.
The Customer will be informed of the applicable charges before the booking is confirmed.
Venue Address Confirmation
The Customer is responsible for providing the correct venue name, street address, suburb and relevant access instructions.
BARU may ask the Customer to reconfirm the venue address, delivery details and access arrangements before the event.
If the venue changes after booking, the Customer must notify BARU as soon as possible.
The new venue and travel distance must be approved by BARU before delivery, setup or collection services can be confirmed for the new location.
A change of venue may result in additional charges or BARU being unable to provide delivery, setup or collection to the new location.
Venue Permission
The Customer is responsible for obtaining any permission required from the venue for BARU to deliver, install, display and collect the Hire Items.
The Customer must advise BARU in advance of relevant venue requirements, including parking restrictions, loading zones, stairs, lifts, security access, loading docks, installation time restrictions, ceiling or wall restrictions and other access conditions.
Delivery Charges
BARU’s standard delivery service starts from $40 each way.
The final delivery and collection price depends on the venue location, travel distance, quantity and size of Hire Items and delivery requirements.
The exact delivery and collection charges will be provided to the Customer and agreed before the booking is confirmed.
Setup Charges
Professional setup starts from $50 for a standard installation.
Larger, more complex or time-consuming installations will be individually quoted according to the Hire Items, quantity, venue conditions, installation requirements and time required.
The exact setup charge will be agreed with the Customer before the booking is confirmed.
Collection After the Event
Where BARU collection is included in the booking, the Customer must ensure the Hire Items are accessible and ready for collection at the agreed date and time.
If BARU cannot access the venue at the agreed time because appropriate access has not been arranged, reasonable additional waiting, travel or collection charges may apply.
13. Accessories and Components
All accessories supplied with Hire Items, including chargers, cables, remotes, batteries, stands, boxes, containers and other components, remain the property of BARU.
All supplied accessories must be returned.
Missing, lost, stolen or damaged accessories may be charged at their reasonable repair or replacement cost.
14. Cleaning
Hire Items should be returned in reasonably clean condition.
Normal cleaning resulting from ordinary event use is not considered damage.
Where Hire Items require cleaning substantially beyond what would normally be expected after reasonable use, BARU may charge a reasonable additional cleaning fee.
Customers must not use chemicals, solvents or cleaning products on Hire Items unless approved by BARU.
15. Damage, Loss, Theft and Replacement Costs
The Customer is responsible for taking reasonable care of all Hire Items and accessories.
The Customer must notify BARU as soon as reasonably possible if a Hire Item is damaged, broken, lost or stolen.
Customers will not be charged for reasonable wear and tear.
If an item can reasonably be repaired, the Customer may be charged the reasonable repair cost.
If an item cannot reasonably be repaired, the Customer may be charged its reasonable replacement cost.
If a Hire Item is lost, stolen or not returned, the Customer may be responsible for the reasonable replacement cost.
BARU may deduct applicable repair or replacement costs from the security bond.
If the cost is greater than the security bond, the Customer must pay the difference. The security bond does not limit the Customer’s responsibility for the full reasonable repair or replacement cost.
BARU will not automatically retain the entire security bond when an item is damaged or an accessory is missing. Only the reasonable applicable amount will be deducted and the remaining bond will be refunded.
Example – Damage: If the Customer paid a $150 security bond and an item reasonably costs $40 to repair, BARU may deduct $40 and refund $110.
Example – Lost, Stolen or Not Returned: If the Customer paid a $150 security bond and an item reasonably costs $350 to replace, BARU may apply the $150 bond towards the replacement cost and the Customer must pay the remaining $200.
Any outstanding amount must be paid within ten (10) days after BARU provides the Customer with details of the amount owing.
BARU will notify the Customer of any deduction and, where reasonably practicable, provide supporting information such as photographs, repair costs, replacement costs or receipts.
16. Changes to a Booking
Requests to add, remove or change Hire Items or services after booking are subject to availability.
Changes may result in adjustments to the hire price, security bond, delivery, setup or collection charges.
BARU will advise the Customer of applicable price changes before accepting the requested change wherever reasonably practicable.
17. Customer Cancellations, Rescheduling and Refunds
All cancellation or rescheduling requests must be made in writing.
More Than 30 Days Before the Event
If the Customer cancels more than 30 days before the event, amounts paid will be refunded less the booking deposit and any reasonable non-recoverable costs already incurred specifically for the booking, such as approved customised or specially ordered items.
Subject to availability, BARU may offer to transfer the booking deposit to another event date.
Between 11 and 30 Days Before the Event
If the Customer cancels between 11 and 30 days before the event, the booking deposit will be non-refundable.
Any additional amounts already paid will be refunded, less reasonable non-recoverable costs specifically incurred for the booking.
Subject to availability, BARU may allow the booking to be transferred to another event date.
10 Days or Less Before the Event
If the Customer cancels ten (10) days or less before the event, a cancellation fee equal to 20% of the total booking value will apply.
The 20% cancellation fee is not charged in addition to the booking deposit. Any booking deposit already paid will be credited towards the 20% cancellation fee.
Any amount paid above the 20% cancellation fee will be refunded, subject to any additional reasonable and non-recoverable costs specifically incurred for the booking, including approved customised or specially ordered items.
Example: If the total booking value is $500, the 20% cancellation fee is $100. If the Customer has already paid $500, BARU will retain $100 and refund $400, subject to these Terms & Conditions.
Security Bond Following Cancellation
The security bond is separate from cancellation charges.
If the booking is cancelled before Hire Items have been collected, delivered or installed, any security bond already paid will be refunded in full, provided no other amount is properly owing.
Rescheduling
Where the Customer wishes to change the event date instead of cancelling, BARU will make reasonable efforts to transfer the booking to the new date, subject to availability.
Additional costs resulting from the change will be discussed before the rescheduled booking is confirmed.
Serious Illness or Exceptional Circumstances
Where cancellation or rescheduling occurs because of serious illness, hospitalisation, bereavement or another exceptional circumstance, the Customer should contact BARU as soon as reasonably possible.
BARU will consider the individual circumstances and may offer a rescheduled date, credit or refund, taking into account reasonable costs already incurred and applicable consumer-law requirements.
18. Cancellation by BARU
If BARU cannot provide the agreed Hire Items or services for reasons within BARU’s control, BARU will contact the Customer as soon as reasonably possible.
Depending on the circumstances and the Customer’s applicable rights, BARU may offer an appropriate replacement, rescheduling, credit or refund.
19. Events Outside Reasonable Control
If an event cannot proceed because of circumstances outside the reasonable control of BARU or the Customer, including severe weather, natural disaster, government restrictions, venue closure or another emergency, BARU and the Customer will attempt to reach a reasonable solution.
Depending on the circumstances, this may include rescheduling, credit, replacement arrangements or another reasonable solution, taking into account costs already reasonably incurred and applicable consumer rights.
20. Product Appearance and Variations
Some BARU decorations use artificial flowers, feathers, lighting and other decorative components.
Minor variations in colour, positioning, arrangement, shape or appearance may occur between photographs and the actual Hire Items supplied.
Where a specific colour, arrangement, design or customisation is essential, this must be agreed with BARU before the booking is confirmed.
21. Venue Requirements
The Customer is responsible for confirming that the venue permits the Hire Items and any required installation.
The Customer must provide BARU with relevant venue rules, access requirements and restrictions before the event.
BARU is not responsible for a venue refusing installation or use of Hire Items where the Customer did not obtain the necessary permission or provide BARU with relevant restrictions in advance.
22. Safety and Responsible Use
Customers and their guests must use Hire Items responsibly and for their intended purpose.
Open flames, candles, excessive heat and other ignition sources must be kept a safe distance from artificial flowers, feathers, fabrics, electrical equipment and other Hire Items that could be damaged or create a safety risk.
Customers must not attempt to repair damaged or malfunctioning equipment.
23. Liability and Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
To the extent permitted by law, BARU is not responsible for loss, damage or injury caused by misuse of Hire Items, unauthorised alteration, failure to follow reasonable instructions, unsafe relocation of professionally installed Hire Items, or acts or omissions of the Customer, venue or third parties.
24. Privacy
Customer information collected by BARU in connection with a booking may be used to manage the booking, process payments, organise delivery, setup and collection, communicate with the Customer and provide the agreed products and services.
BARU will take reasonable steps to handle Customer information appropriately.
25. Acceptance of Terms & Conditions
By confirming a booking and paying the required booking deposit, the Customer acknowledges that they have read, understood and agreed to these Hire Terms & Conditions.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
